News Release - City Parking Enforcement Officer Charged with Misconduct, Harassment

(Thursday, May 31, 2012) – Following an investigation conducted by the City’s Office of Public Integrity, criminal charges were filed today against Parking Enforcement Officer Damon Finegan. Mr. Finegan has been charged with Official Misconduct and First-degree Harassment, both misdemeanors, stemming from two separate incidents that occurred on April 3, 2012.

“These charges allege that a City employee whose duty it is to help citizens actually made situations worse on two separate occasions and violated the law in the process,” said OPI Director George Markert. “The City of Rochester will continue to hold all of its employees to the highest standards of ethical and legal behavior.”

In the first incident, Mr. Finegan is charged with responding without authorization to a call for police assistance regarding a stolen vehicle, which interfered with the police investigation and deprived the caller of police services. In the second, he is charged with acting in a manner that created a substantial fear of injury for a citizen to whom Mr. Finegan had issued a parking violation.

Mr. Finegan, 47, has been a Parking Enforcement Officer for 19 years. He has been placed on paid administrative leave pending an internal investigation. He was arraigned in City Court today and released on his own recognizance. His next court date is June 22.
